Qualifying for Chapter 7 Bankruptcy

The State median income for a family of four is $66,256. If your family income is less than that, you would qualify for Chapter 7 Bankruptcy easily. If your income exceeds that, you may still qualify if you pass the means test, which is designed to allow debt repayment by those who can afford it. If you do not pass the means test, you may still qualify for Chapter 13 Bankruptcy protection.

If you decide to move forward with Chapter 7 Bankruptcy, you must complete required credit counseling education to meet bankruptcy requirements. Enter attorney code RL4722 to have a certificate of completion sent to our office for the two required courses.

Exemptions for Chapter 7 Bankruptcy in Louisiana

When an individual files for protection under Chapter 7, much of their personal property/assets are exempt under state and/or federal law. This means that you will not lose such property. For example, the first $35,000 of equity in your primary residence is exempt. Louisiana debtors also get one vehicle exemption up to $7,500.00. Further, qualified retirement plans and pensions are 100% exempt as are the debtor's household goods and furnishings (exclusive of electronic items), personal wardrobes, wedding rings, one firearm and certain tools of trade. Some debts are not eligible for discharge, including student loans, child support payments and certain taxes owed.
