If creditors have been hounding you for money you don't have, you may benefit from Chapter 7 Bankruptcy protection. When your case is filed, an automotic stay will immediately prevent creditors from contacting you for payment of outstanding debts. When your case is completed, most, if not all, of your unsecured debt will be discharged or eliminated, providing you with a TRUE FRESH START that you so desperately need.

Many clients have an irrational fear of filing for bankruptcy protection but in most cases this fear is unwarranted. We see meet with clients every single day and enjoy changing clients understanding and perception of the bankruptcy process. The mission of our attorneys is to provide excellent consumer bankruptcy counsel. We work hand in glove with clients who need to gather the appropriate paperwork and get it filled out properly. As your attorneys, we analyze your financial situation and recommend legal remedies, including Chapter 7, a debt relief plan, or Chapter 13 Bankruptcy, a wage earner's plan.

Contact the firm to discuss your case with a qualified attorney.

Qualifying for Chapter 7 Bankruptcy

Currently there are income limits based on your household size in order to qualify for a Chapter 7; however, even if your household income exceeds this limit, you may still qualify if you pass the means test, thus it is important to personally meet with a qualified bankrutpcy attorney. If you do not pass the means test, you may still qualify for Chapter 13 Bankruptcy protection.

If you decide to move forward with Chapter 7 Bankruptcy, you must complete required credit counseling education to meet bankruptcy requirements. Enter attorney code RL4789  to have a certificate of completion sent to our office prior to filing.

Exemptions for Chapter 7 Bankruptcy in Louisiana

When an individual files for protection under Chapter 7, much of their personal property/assets are exempt under state and/or federal law. This means that you will not lose such property. For example, the first $35,000 of equity in your primary residence is exempt. Louisiana debtors also get one vehicle exemption up to $7,500.00. Further, qualified retirement plans and pensions are 100% exempt as are the debtor's household goods and furnishings (exclusive of electronic items), personal wardrobes, wedding rings, one firearm and certain tools of trade. Some debts are not eligible for discharge, including student loans, child support payments and certain taxes owed.
